SMS Consent and Opt-in language

This document contains the approved consent, opt in and disclosure wording for the SmartPackingUSA text messaging programme, together with implementation notes for the website, the checkout, payment links, the sales team and the A2P 10DLC campaign registration.

The wording in Sections 2 to 9 is intended to be used as written. Where a field is to be completed, it is shown in capitals. Do not shorten the disclosure wording, do not pre tick a consent box, and do not bundle messaging consent with acceptance of any other agreement.

1. Rules That Apply to Every Opt In.

1.1 Consent must be express, must be given by the person who uses the mobile number, and must be given specifically for text messages from SmartPackingUSA.

1.2 Every marketing opt in must be a separate, unticked checkbox. It must not be pre selected, must not be combined with acceptance of the Terms of Service, the Privacy Policy or the Purchase, No Returns and Cancellation Policy, and must not be a condition of submitting the form or completing a purchase.

1.3 The disclosure displayed immediately with the opt in must state: the identity of the sender; the type of messages; that consent is not a condition of purchase; that message frequency varies; that message and data rates may apply; that the recipient can reply STOP to cancel and HELP for help; and links to the SMS Program Terms and Conditions and the Privacy Policy.

1.4 Consent must be recorded. For every opt in, keep the mobile number, the date and time, the source form or channel, the exact wording displayed or read, and the identity of the person who consented.

1.5 Consent is not transferable between numbers, is not shared with any third party, and cannot be assumed from a business card, a purchase, a website visit or an email signature.

1.6 Opt out requests must be actioned immediately and automatically, and the number added to the internal do not message list.


 

2. Website Consent Checkbox, Marketing Programme.

2.1 Use this on the contact form, quote request form, dealer application form and account registration page, beneath the mobile number field.

2.2 Checkbox label: Yes, send me text messages from SmartPackingUSA.

2.3 Disclosure text displayed with the checkbox: By ticking this box you agree to receive marketing and promotional text messages, including product announcements and promotions, from SmartPackingUSA at the mobile number provided. Messages may be sent using an automated system. Consent is not a condition of any purchase. Message frequency varies and is expected to be no more than 4 messages per month. Message and data rates may apply. Reply STOP to cancel or HELP for help. 2.4 The mobile number field label should read: Mobile number, for order updates and text messages.

2.5 Do not make the checkbox mandatory and do not prevent the form from being submitted where it is left unticked.


 

3. Website Consent Checkbox, Order and Support Messages.

3.1 Use this at checkout and on the quote request form where the customer is offered order related messaging.

3.2 Checkbox label: Send me order and delivery updates by text message.

3.3 Disclosure text displayed with the checkbox: By ticking this box you agree to receive text messages from SmartPackingUSA about your quotation, order, artwork approval, production, shipment, delivery and support case at the mobile number provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. 3.4 Keep this checkbox separate from the marketing checkbox in Section 2. A customer who accepts order updates has not consented to marketing messages.


 

4. Checkout Acknowledgement of Purchase and Return Terms.

4.1 This is a separate, mandatory acknowledgement and is not a messaging consent. It should be a required unticked checkbox immediately above the payment button.

4.2 Checkbox label: I have read and agree to the Terms of Service and the Purchase, No Returns and Cancellation Policy, and I understand that all sales are final.

4.3 Supporting text displayed with the checkbox: All sales are final. We do not accept returns, exchanges or cancellations for change of mind or for goods ordered in error. Wrong items, missing items, shipping damage and verified warranty defects are handled under our Purchase, No Returns and Cancellation Policy at https://www.smartpackingusa.com/purchase-and-returns-policy and our Warranty Policy at https://www.smartpackingusa.com/warranty-policy. Please inspect your shipment on arrival. Any broken, torn, crushed, punctured, wet or otherwise visibly damaged packaging or goods must be photographed and noted with the carrier on the delivery receipt at the time of delivery. All shipping damage, including concealed damage found after opening the shipment, must be reported to us with photographs within 24 hours of delivery. Wrong or missing items must be reported within 2 business days.

4.4 Shipping notice to display alongside the checkout acknowledgement and to repeat in the order confirmation email: Inspect your shipment on arrival before the driver leaves. Photograph any broken, torn, crushed, punctured, wet or otherwise visibly damaged packaging or goods, and have the damage noted on the carrier delivery receipt before you sign. Report all shipping damage, visible or concealed, to info@smartpackingusa.com or (239) 227-5399 within 24 hours of delivery, with photographs.

4.5 Record the date, time, internet protocol address and policy version accepted against the order, and store that record with the order for at least 2 years. This record is the evidence used to respond to a payment dispute.


 

5. Product Page and Cart Notice.

5.1 Short notice for display on every product page near the price and add to cart button: All sales final. No returns or exchanges. Wrong, missing or damaged items and warranty defects are covered. Please inspect on delivery and report any shipping damage within 24 hours. See our Purchase, No Returns and Cancellation Policy.

5.2 Short notice for display in the cart and order summary: All sales are final. Please check your model, size, quantity and configuration before ordering. Contact us on (239) 227-5399 if you need help selecting.

5.3 Machine product pages should additionally display: Includes a 12 month warranty. An optional extended warranty is available at the price shown for this model


 

6. Payment Link and Invoice Wording.

6.1 Where payment is taken by a payment link rather than through the online store, the same disclosure and acknowledgement must be presented before payment is completed.

6.2 Enable the terms of service acceptance option on the payment link so that the customer must tick a box before paying, and point it to https://www.smartpackingusa.com/purchase-and-returns-policy.

6.3 Custom message to display on the payment page: All sales are final. No returns, exchanges or cancellations for change of mind or for goods ordered in error. Wrong items, missing items, shipping damage and verified warranty defects are handled under our Purchase, No Returns and Cancellation Policy. Please inspect your shipment on arrival, photograph and have the carrier note any visibly damaged packaging or goods on the delivery receipt, and report all shipping damage, visible or concealed, within 24 hours of delivery. By completing this payment you confirm that you have read and accepted our Terms of Service, Purchase, No Returns and Cancellation Policy and Warranty Policy.

6.4 Wording to include in the email, quotation or invoice that carries the payment link: This order is subject to our Terms of Service, our Purchase, No Returns and Cancellation Policy and our Warranty Policy, available at https://www.smartpackingusa.com. All sales are final. Please confirm the model, size, quantity and configuration on this quotation before paying. Completing payment confirms your acceptance of those terms and, for custom goods, your approval of the specification stated in this quotation.

6.5 Where the payment link relates to custom goods, include the approved specification, drawing reference or artwork proof reference in the quotation, and add: Approval of this specification makes this order non cancellable and non refundable.

6.6 Save the payment page record, the accepted terms record and the quotation or invoice against the order in the customer relationship management system


7. Verbal Consent Script for Sales Representatives.

7.1 Use this script when a customer gives a mobile number by telephone and agrees to receive text messages. Read it in full and do not paraphrase.

7.2 Script: May I send you text messages at this number about your quotation and order? We would also like to send you occasional product and promotion messages. This is not a condition of buying anything, message frequency varies, message and data rates may apply, and you can reply STOP at any time to stop the messages or HELP for help. Our SMS terms and privacy policy are on our website at https://www.smartpackingusa.com. Do you agree to receive text messages from SmartPackingUSA at this number?

7.3 Record in the customer relationship management system, on the contact record: the date and time; the number consented; whether consent covers order messages only or also marketing; the representative's name; and a note that the script above was read and consent was given verbally.

7.4 If the answer is anything other than a clear yes, do not add the number to the marketing programme.

7.5 Where the number belongs to an employee or colleague of the customer, ask the customer to confirm that the individual has agreed, and record that confirmation.


 

8. Automated Reply Messages.

8.1 Opt in confirmation message, sent once immediately after consent: SmartPackingUSA: You are subscribed to text messages about our packaging machines, containers and films. Msg frequency varies. 8.4 Keyword opt in reply, where a customer texts a published keyword: SmartPackingUSA: Thanks for subscribing to product and promotion texts. Msg frequency varies, no more than 4 msgs/month expected. 8.5 Every automated reply must remain accurate if the programme changes. Review these messages whenever the programme or the frequency estimate changes.


 

9. Sample Messages for Registration and Ongoing Use.

9.1 Quotation follow up: SmartPackingUSA: Hi NAME, your quote QUOTE NUMBER for the MODEL machine and TRAY REFERENCE trays is ready. Any questions, call (239) 227-5399. Reply STOP to opt out.

9.2 Artwork approval: SmartPackingUSA: Hi NAME, the print proof for your custom sealing film order ORDER NUMBER is in your email for approval. Production starts once you approve. Reply STOP to opt out.

9.3 Dispatch notice: SmartPackingUSA: Hi NAME, order ORDER NUMBER has shipped by CARRIER, tracking TRACKING NUMBER. Signature is required on delivery. Inspect on arrival, photograph any damage and note it with the driver, and report to us within 24 hours. Reply STOP to opt out.

9.4 Delivery coordination: SmartPackingUSA: Hi NAME, the freight carrier will call to arrange delivery of your MODEL machine. Please have someone available to sign and inspect. Reply STOP to opt out.

9.5 Support update: SmartPackingUSA: Hi NAME, the replacement PART NAME for machine SERIAL NUMBER shipped today under warranty at no charge. Fitting instructions are in your email. Reply STOP to opt out.

9.6 Marketing message: SmartPackingUSA: New sugarcane tray sizes now in stock, with matching molds and sealing films. See https://www.smartpackingusa.com Msg & data rates may apply. Reply STOP to opt out.


 

10. A2P 10DLC Registration Notes.

10.1 Register the brand in the name of the legal entity, Yildiz Prime Inc., using its employer identification number, registered legal address and legal entity type exactly as filed, and identify SmartPackingUSA as the trading name. Inconsistency between the registered brand details and public records is the most common cause of rejection and of poor message deliverability.

10.2 Register separate campaigns matching the actual message categories, typically one campaign for customer care and account notifications and one for marketing and promotional messages, rather than a single mixed campaign.

10.3 The campaign use case description should describe the business and the messages plainly, for example: SmartPackingUSA sells commercial food packaging machines, trays, containers and sealing films to food businesses in the United States. Messages are sent to customers and enquirers who have opted in, and cover quotations, order and artwork approvals, shipping and delivery updates, warranty and support cases, and occasional product and promotional announcements.

10.4 The opt in description submitted with the campaign must match the wording actually used on the website and by the sales team, and must reference the consent language in Sections 2, 3 and 7 of this document.

10.5 Provide the required evidence of opt in, which typically includes a screenshot or hosted image of the live web form showing the unticked consent checkbox and the full disclosure wording, and the public URL of the SMS Program Terms and Conditions and the Privacy Policy.

10.6 Include at least two sample messages drawn from Section 9, each identifying the brand and each containing opt out language, and ensure that the sample messages match what is actually sent.

10.7 Confirm in the campaign submission that STOP and HELP keywords are supported and handled automatically, that messages are not sent to numbers that have opted out, and that consent is not shared with third parties.

10.8 Ensure the messaging platform is configured so that STOP processing is automatic and immediate, that the opt out is recorded on the contact record, and that a suppressed number cannot be re added by a bulk import.

10.9 Keep the registered brand, campaign details, sample messages, opt in wording and frequency estimate under review, and update the registration when the website wording or the programme changes.

10.10 Messaging through the programme must comply with carrier and industry messaging requirements as well as with applicable law. Content categories restricted by carriers must not be sent through these campaigns.


 

11. Record Keeping and Internal Compliance.

11.1 Keep the consent record for every number for as long as the number is messaged and for at least 5 years afterwards, so that consent can be evidenced if a complaint or claim is made.

11.2 Keep a dated copy of every version of the website consent wording, the SMS Program Terms and Conditions and the checkout acknowledgement, so that the version in force at the time of any given consent can be produced.

11.3 Do not import mobile numbers from purchased lists, scraped sources or third party lead providers into the messaging programme.

11.4 Train every sales representative on the verbal consent script, the opt out obligations and the prohibition on messaging numbers that have opted out, and keep a record of that training.

11.5 Review opt out handling monthly to confirm that STOP requests were actioned and that no messages were sent to suppressed numbers.

11.6 Escalate any complaint about unwanted messages, and any demand letter or notice concerning text messaging, to management immediately and preserve all records relating to the number concerned.
